The case study is about labor relations that Happy Trails, LLC., an independent living home, and its employees must decide which action each will take. The company hired a group of consultants for advice from both sides. Employees must decide to unionize or not, and the management team will have to consider the company’s rights and how to execute them. Both sides need to be careful of unfair practices. This paper will explore concerns from both the employees and the company and also provide advice according to labor laws.
The Licensed Practical Nurses (LPNs) are seeking advice on unionizing and the steps to follow, advantages and disadvantages of unionizing at Happy Trails, considering issues the union might raise during the organizing effort, and learning the unfair labor practices they need to avoid. We believe the employees should attempt conflict resolution by having a meeting with the management team first. Changes will occur if a union is established. Advantages would include negotiations for steady raises, better wages and insurance, and protection against terminations without investigation. However; employees should consider membership fees, the company is only required to bargain on wages, hours, and work conditions. Happy Trails can establish a lockout in the event of a strike and replace positions with new or temporary employees. All strikers are not entitled to reinstatement.
